Thank you for your business and continued patronage at Stockpile Defense. This Agreement represents a legally binding contract. Please read the following terms carefully. If you have any questions or concerns regarding the terms of this Agreement, please consult an attorney before signing. Your signature represents an informed and complete understanding of this Agreement. Any outside conversations not contained or noted in this Agreement which may have a contradictory, supplemental, or otherwise modifying effect on the language of this Agreement will have no legal effect.

I. Parties

This Agreement is between the Consignor (hereinafter “Seller”) and Consignee (hereinafter “Stockpile Defense”) (“Stockpile”) for a firearm. The following terms apply to all firearms that Seller wishes Stockpile Defense to consign, market, and sell on behalf of Seller. This Agreement takes effect upon Seller’s signature and the transfer of possession of the firearm to Stockpile Defense.

II. Terms and Duration

Price for Firearms:

The minimum fee for consignment is $80.00 for in-store consignments and $85.00 for online consignments. This fee covers Stockpile Defense’s overhead costs of cleaning, inspecting, test-firing, and marketing the consigned firearm. For large-value items over $300.00, the cost of consignment is 25% of the value of the firearm for in-store consignments and 30% for online consignments. After the sale of Seller’s firearm, the consignment fee will be deducted from Seller’s proceeds by Stockpile Defense. If Seller wishes the proceeds to be converted to store credit, the cost of consignment will be reduced to 20% and all surplus proceeds from the sale will be deposited into Seller’s in-store account. Payments will be distributed to Seller by business check within fifteen (15) business days. Store-credit will be available on Seller’s in-store account within seven (7) business days.

Terms:

For each consignment firearm, Seller must provide (at a minimum) a carrying case or the original box, (1) box of test fire ammo for EACH firearm on consignment and (1) magazine if required for the consigned firearm. The test fire ammo is required to ensure proper function and operation of each firearm prior to the items being offered for sale.

Duration of Agreement:

The duration of Consignment is ninety (90) days. The consignment terms will automatically renew every 90 days until the firearm is sold or Seller notifies Stockpile by e-mail or other written instrument that Seller wishes to terminate the Consignment Agreement.

III. Termination:

If Seller decides to terminate this Consignment Agreement, Seller understands that the in-store $80.00 or online $85.00 (whichever is applicable) cleaning, inspection, function-testing, and marketing fee is non-refundable. Any/all shipping fees will also be the sole responsibility of the seller. If Seller terminates this Agreement after 90 days and wishes to regain possession of the consigned firearm, Federal law requires Stockpile to conduct and receive an approved standard background check on Seller before releasing possession of the firearm to Seller. If Seller cannot pass the standard background check as required by Federal Law, Seller will forfeit the consigned firearm to the ATF or Stockpile Defense. If the consigned firearm is forfeited to Stockpile Defense, Stockpile will make all reasonable efforts to sell the firearm. Once sold, the proceeds will be distributed according to Idaho and Federal law to Seller or Seller’s Estate. If the firearm cannot be sold, Stockpile will surrender the firearm to the Federal Bureau of Alcohol, Tobacco, and Firearms.

IV. Seller’s Sworn Declaration:

I, the undersigned Seller of this Consignment Agreement, hereby swear and affirm under Idaho and Federal law, and under the penalty of perjury, that I am the lawful owner of the consigned firearm(s). I separately swear and affirm that the firearm(s) are not legally encumbered in any way. Seller accepts and understands that the consigned firearm(s) may be subjected to a criminal inspection through Boise Police Department at Stockpile’s discretion at any time and for any reason. Seller hereby agrees to indemnify Stockpile Defense for any damages or liability which may arise out of the sale of Seller’s consigned firearm(s).
